  • “Agreement” means these terms and conditions as amended from time to time; “Content” means any text, image, sound or graphic placed or submitted on this Website or where the context requires, the websites of third parties;
  • “Services” means the services offered in or via this Website;
  • “Website” means any related linked pages or domains to Travelinc.com.sg and Travelinc.sg

1.2    Your usage, access, visits or booking at this Website is on the express condition that You accept without variation the Agreement. The information contained in this Website may be amended by Us from time to time without notice to You. You need to review the Agreement each time You use this Website.

1.3    Your usage, access, visits or booking at this Website constitutes Your acceptance of the Agreement. If You do not agree to any part of the Agreement, You must not use this Website.

2.0 Use of this Website

As a condition of Your use of this Website, You fully represent and warrant that

  • You are at least 21 years of age,
  • You possess the legal authority to create a binding legal obligation,
  • You will use this Website in accordance with this Agreement,
  • You will only use this Website to make legitimate reservations for You or for another person for whom You are legally authorized to act,
  • All information supplied by You on this Website is complete, true, accurate, current and complete,
  • You shall not post or transmit any unlawful, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law, and
  • If You have a Travelinc.com.sg account, You will safeguard Your account information and will supervise and be completely responsible for any use of Your account by anyone other than You. We retain the right at Our sole discretion to deny access to anyone to this Website and the Services We offer, at any time and for any reason, including, but not limited to, for violation of this Agreement.

3.0 Restrictions On Use Of Materials

3.1    Nothing in this Agreement shall be construed as granting to You any additional right, title or interest in any intellectual property rights belonging to Us or to a third party. Modification of any of the materials or use of the materials for business or commercial purposes or for exploitation will be a violation of Our copyright and other intellectual property rights and the copyright and other intellectual property rights of the respective owners.

3.2    Subject to the limitations and restrictions set out in this Agreement, You are permitted to use the Content for Your own personal non-business use.

4.0 Disclaimer

4.1    This Website, the Services and the Content are provided “as is”. We make and You receive no warranties, conditions or representations, express or implied, statutory or otherwise. In particular but without limitation We do not warrant that this Website will be operational, uninterrupted and/or error or virus free.

4.2    In no event will We be liable for any direct, consequential, incidental, or special damage or loss of any kind (including without limitation loss of profits, loss of contracts, business interruptions or loss of or corruption to data) however caused and whether arising under contract, tort, including negligence, or otherwise.

4.3    To the fullest extent permitted by law, We are not and You accept that We are not liable or responsible for any consequences (financial or otherwise) arising from You meeting or communicating with people via or as a consequence of this Website and the Services offered through it.

4.4    You acknowledge that the allocation of risk in this Agreement is fair and reasonable in all the circumstances and that it is not within Our control how and for what purposes You use or rely on the Content and/or Services provided via this Website.

We do not make any representation or warranty that information contained in other websites to which this Website (or any part of it) links is accurate, complete, current or authentic nor is such hyperlink an endorsement of such third party, its website and/or Content.

6.0 Limitation of Liability

6.1    We, Our affiliates, and/or Our respective suppliers hereby disclaim all warranties and conditions with regards to this information, software, products, and Services, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title, and non-infringement.

6.2    Without limiting the generality of clause 6.1 above, we do not endorse and will not be liable for:

  • The accuracy or reliability, timeliness, authenticity of completeness of any information, opinion, advice or statement made through this Website by any party other than Us,
  • Any Content provided on linked websites,
  • The capabilities or reliability of any product or service obtained from a linked website
  • The acts, errors, omissions, representations, warranties, breaches or negligence of any of Our suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting there from, and
  • Refunds in the event of any delay, cancellation, overbooking, strike, force majeure, acts of terrorism, sickness or other causes beyond Our control,
  • Any additional expense, omissions, delays or acts of any government or authority.

6.3    In no event shall We and/or Our respective suppliers be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, the use of this Website or with the delay or inability to use this Website, or for any information, software, products, and Services obtained through this Website, or otherwise arising out of the use of this Website, whether based on contract, tort, strict liability, or otherwise, even if We and/or Our respective suppliers have been advised of the possibility of damages. Our total liability (if any) for all damages, losses, costs and expenses under whatever causes of action, whether in contract, tort or otherwise will not exceed any amount paid by You for accessing this Website.

7.0 Booking Conditions

  • Reservations are subject to the applicable fare conditions and seat availabilities in that fare group.
  • All prices displayed or stated on this Website are in Singapore Dollars (SGD) based on per person unless otherwise stated.
  • All prices displayed or stated on this Website are indicative only and shall not be deemed binding on Us. All prices will be subject to change without prior notice in the event of unforeseen circumstances including without limitation currency fluctuations, irregular increase in airfares, hotel rates and government tax until full payment has been made by You and has been acknowledged and accepted by Us.
  • Unless otherwise stated, all prices displayed or stated on this Website exclude prevailing service fees, airport taxes, airlines’ insurance taxes, airlines’ fuel surcharges, visa fees, travel insurance, excess baggage charges, flight insurance and other mandatory entry or exit taxes to be paid by passengers at the immigration and checkpoints of the respective country.
  • Unless otherwise stated, all prices displayed or stated on this Website for tour packages exclude airport taxes, airlines’ insurance taxes, airlines’ fuel surcharges, visa fees, travel insurance, excess baggage charges, flight insurance and gratuities to driver, tour guide or tour leader. Meals, beverages, room service or any other benefit not listed in the itinerary for the tour package is also excluded.
  • Airport taxes, airlines insurance taxes and fuel surcharges are subject to change in the event of foreign currency fluctuations and the irregular increase of fuel surcharges by the airlines. As such, all such taxes and surcharges are not guaranteed until tickets/tour packages have been issued and full payment has been made by You and has been acknowledged and accepted by Us.
  • We reserve the right to cancel, withdraw or decline to accept any booking made via the Website if the fares displayed on the Website are found to be in error or have been withdrawn by the airlines before full payment has been made by You and acknowledged and accepted by Us.
  • Your failure to provide Us with personal information correctly and completely may result in passengers being denied boarding, or delay and deportation back to the passenger’s origin.
  • Child fare is applicable to children between the ages of 2yrs and 12yrs at the time of departure from Singapore who must travel with an adult on the same reservation.
  • We will not be responsible or liable for any expenses, including without limitation the reimbursement or refund of any air fares, tour packages, hotel accommodations, insurance fees or car rental charges if entry is refused by any country for whatever reason, including the lack of the necessary entry or transit visa.

8.0 Travel Requirements

It is Your responsibility to ensure that all travel requirements are fulfilled including without limitation that Your international passport has a validity of at least 6 months from the date of departure and that the expiry date is acceptable in all the countries which You will enter and that the necessary visas have been obtained.

9.0 Visa

In the event that You require Our assistance to apply for visas We are able to assist if You are a Singaporean, a Singapore Permanent Residents or holding a Singapore Employment Pass or Work Pass for a service charge of SGD 25.00. This does not include the charges payable to the relevant authority for Your visa in respect of which You shall be liable. We do not guarantee the approval of Your visa application.

10.0 Deposit

10.1    Unless otherwise stated, a deposit is not required for booking or purchasing of air tickets, hotel accommodation, car rentals, AIG insurance and gift certificates.

10.2    For tour packages however, a minimum deposit equivalent to 30%-50% of the total tour package value or a stipulated fixed amount is required upon booking. The deposit amount varies subject to the tour package selected.

11.0 Cancellation

11.1    Air Tickets

  • Most of the fares offered on Our Website have no refund value, cannot be changed, reissued, or transferred to another traveller. We do advise You to read through the terms and conditions of the fare before proceeding to request a cancellation.
  • All cancellations must be made in writing at least 3 working days prior to the departure of the flight. For cancellations less than 3 working days prior to the departure of the flight, please contact the airline directly to avoid no show fees being imposed.
  • Cancellation must be made in writing to avoid misunderstanding. Your written instructions must be received by Us to be effective and We shall revert to You within 2 working days of receipt of Your written instructions.

11.2    Tour Packages

  • Cancellation of tour package bookings must be made in writing to avoid misunderstanding and must be received by Us to be effective. We shall revert to You within 2 working days of receipt of Your written instructions.
  • A handling fee of SGD30.00 will be levied per passenger in addition to the cancellation fees imposed as follows:

11.3    Cancellation of Tour by Us

At times, due to low subscription for a particular tour package, We may choose to cancel the entire tour package. As such, We may recommend alternative tour packages to the same destination or other tour packages to You, based on the tour fare of that period. Should You decided not to accept the alternatives offered by Us, all amounts paid to Us for the booking of the tour package will be refunded. All refunds will be paid to You as soon as possible. In most cases, the refund should be paid within a month of Your confirmation that You do not wish to accept the alternatives offered. However, during peak periods, refunds may take up to 3 months to be paid. No compensation shall be payable by Us to You.

12.0 Amendments

12.1    Air Tickets

  • Most of the fares offered on this Website have no refund value, cannot be changed, reissued, or transferred to another traveller. We do advise You to read through the terms and conditions of the fare before requesting any amendment.
  • All amendments must be made in writing at least 3 working days prior to the departure of the flight.
  • Amendments must be made in writing to avoid misunderstanding. Your written instructions must be received by Us to be effective and We shall revert to You within 2 working days of receipt of Your written instructions.
  • A handling fee SGD25.00 will be levied per amendment per ticket in addition to any amendment/reissue fees imposed by the airlines.

12.2    Tour Packages

  • Amendments of tour package bookings must be made in writing to avoid misunderstanding and must be received by Us to be effective. We shall revert to You within 2 working days of receipt of Your written instructions.
  • Amendments requested are subject to the approval of the respective service suppliers, including the airlines, hotels and/or land operators, who reserve the right to reject amendments at their sole discretion.
  • A handling fee of SGD30.00 per amendment will be levied after Your tour package has been confirmed in addition to any amendment fees imposed by the airlines or hotel. All additional surcharges incurred as a result of the amendment will be borne by You.

12.3    Amendments of Tour Itinerary by Us

Whilst We endeavour not to make any material alternation to the tour packages as set out in the Website, We reserve the right to make changes at any time necessitated by unforeseen circumstances. In such an event no compensation shall be paid to You by Us.

13.0 Refund

13.1    Air Tickets

  • Refunds of flight bookings must be made in writing to avoid misunderstanding and must be received by Us to be effective. We shall acknowledge receipt within 2 working days.
  • Refunds are subject to the terms and conditions of the respective fare applied. Any waiver or reduction of penalties based on compassionate grounds is contingent on conditions imposed by the airlines.
  • Processing time for refund applications may take up to 3 months depending on the type of tickets and reasons for refund. Certain complicated situations may take a longer processing time as stipulated by the airlines.
  • A handling fee of SGD25.00 will be levied per transaction per ticket in addition to any cancellation/ administration fees imposed by the airlines.

13.2    Tour Packages

  • Even after a deposit of the tour fare is made, all reservations are still subject to confirmation by the respective service suppliers. In the event that the reservation cannot be confirmed, We will endeavour to notify You two weeks (2) prior to the scheduled departure date and a refund of the deposit will be made (if any) through Your credit card company. We shall not be liable for such cancellation, save that We shall make the necessary refund of deposits or tour fares paid as set out herein.
  • Certain tour inclusion may involve the Government’s facilities. In the event that these facilities are re-taken back temporarily by the relevant authorities, a replacement of alternative programmes or facilities will be made or a refund will be made as determined by Us to be appropriate.
  • Requests for refunds of tour package bookings must be made in writing to avoid misunderstanding and must be received by Us to be effective. We shall acknowledge receipt within 2 working days.
  • Refunds are subject to the terms and conditions of the respective tour package and cancellation fees stipulated in the tour brochure and/or the booking form on the Website, as well as the approval of the respective service suppliers, including the airlines, hotels and/or land operators, who reserve the right to reject requests for refunds at their sole discretion.
  • Processing time for refund applications may take up to 3 months subjecting to the approval from the services suppliers, including the airlines and hotels.
  • We shall endeavour not to make any material alternation to the tour package. However, We reserve the right to make minor changes at any time due to unforeseen circumstances without compensation, especially during peak season.

14.0 Gift Certificate

  • Electronic gift certificates may be purchased via the Website only in denominations of S$50.00.
  • An electronic gift certificate number will be generated upon payment by You which is received and acknowledged by Us.
  • Redemption can only be done via the Website with the electronic gift certificate number for a full/partial payment of air tickets or tour packages. We will not refund any unused balance of the electronic gift certificate.
  • All terms and conditions stipulated on the electronic gift certificate have to be met before it shall be accepted as a mode of payment.
  • The electronic gift certificate is not exchangeable and is not refundable for cash.
  • The electronic gift certificate number is not replaceable once lost and no claims will be entertained by Us.
  • The electronic gift certificate is valid for a period of one (1) year from the date of issue.
  • An extension of the validity period is not permitted after the expiry date of the electronic gift certificate.

15.0 Mode of Payment

Payment may be made in Singapore Dollars by cash, bank transfers, credit cards or gift certificates issued by Us. For payments by gift certificates, all terms & conditions stipulated on the gift certificates have to be met before it shall be accepted as a mode of payment.

16.0 Special Request

Any special requests from You such as special meals, dietary requirements, adjoining rooms, accommodation requirements shall be communicated to Us upon making a reservation. Please note, however, that such requests are subject to availability and cannot be guaranteed by Us.

17.0 Accommodation

Accommodation is as specified in the tour brochure and/or the booking form on the Website. Unless specifically mentioned, all rooms will be on ‘run-of-house’ basis. Accommodation for adults is based on twin or double, or triple sharing (if requested by client). In the event that accommodation in the selected hotel is not available, every effort will be made to acquire accommodation in another hotel of a similar standard. When booking triple-share rooms, please note that the third bed may be a ‘roll-away’ bed. Triple sharing for all tours shall be subject to request and availability, as some hotels do not have such facilities for triple share rooms.

18.0 Single Supplement

There will be a single-supplement surcharge for a single room request; amount as indicated in the tour itinerary on the Website.

19.0 Travel Insurance

Purchase of travel insurance is strongly recommended with respect to such areas as trip cancellation, personal accident, injury and illness. Under no circumstances shall the Company be constructed as a carrier under a contract of carriage of a passenger and of his/her baggage and other personal belongings.

20.0 Baggage

All matters relating to baggage allowance, size and excess baggage charges are determined by the airlines We assume no responsibility for any loss or damage to baggage or belongings whilst they are in the custody of airlines, other transportation companies, accommodation suppliers or the passenger. We are not responsible for hand- held luggage.

21.0 Extension of Stay and Deviation

An extension of stay and or deviation may be permitted at the end of the tour itinerary as stated on the Website, subject to the maximum validity and restrictions of the air ticket issued You and the availability of a confirmed return flight and accommodation for You, prior to the scheduled date of departure. It is Your responsibility to hold a confirmed seat for Your return flight. In the event that the requested extension of stay and or deviation cannot be confirmed two (2) weeks prior to the scheduled departure date, You shall be deemed to be participating in the tour package according to the original tour itinerary and under such circumstances the costs or charges imposed, if any, shall be borne by You. Any extension of stay and or deviation will be at Your own expense and transfers to the airport will not be provided by Us. For tour packages involving chartered flights, no extension of stay and or deviation shall be permitted.

22.0 Seat Rotations

For the convenience of all members of the tour group, You may be requested to rotate Your seating arrangements on the tour coach or other land transport during the period of the tour itinerary. Please cooperate when called upon to do so by the tour leader or tour guide.

23.0 Complaints and Claims

Any complaint and or claim shall be made in writing within fourteen (14) days from the date of return to Singapore on the last day of the tour itinerary, for Our investigation. No responsibility is accepted in respect of any complaints and or claims, which are made after fourteen (14) days of return.

24.0 Governing Law & Dispute Resolution

The Agreement shall be governed and construed in accordance with the laws of Singapore and You agree to submit to the non-exclusive jurisdiction.
